Terms and Conditions of Sale

These Terms and Conditions govern the sales contract between Bikenos FZ and the consumer. Before making a purchase, please read this document carefully.

2Scope of Application
These General Terms and Conditions of Sale apply to all sales made on www.bikenos.com and constitute a distance contract governed by Chapter I, Title III (articles 45 et seq.) of Italian Legislative Decree no. 206 of 6 September 2005 (Consumer Code) and Italian Legislative Decree no. 70 of 9 April 2003 (e-commerce regulations).
The terms indicated refer to working days, excluding Saturday, Sunday and national holidays.
These Conditions may be modified at any time. Modifications will be effective from publication on the Site. The applicable Conditions are those in force at the date of order submission.
Submission of a purchase order constitutes full acceptance of these General Terms and Conditions of Sale.
3Definitions
Pursuant to Article 3 of the Consumer Code:
• Consumer: a natural person acting for purposes unrelated to any business, commercial, professional or craft activity they may carry out.
• Professional: a natural or legal person acting in the exercise of their business, commercial, craft or professional activity, or their intermediary.
Purchases on the Site are permitted for both consumers and professionals. Some provisions of these Conditions (particularly those relating to the right of withdrawal and legal warranty) apply exclusively to consumers.
4Subject of the Contract
These Terms and Conditions govern the sale of outdoor products, sportswear, technical equipment and accessories through the website www.bikenos.com.
These Conditions do not govern the sale of products by parties other than the Seller who may be present on the Site through links or banners. Before transacting with such parties, please verify their terms and conditions.
5Order Procedure
In accordance with Italian Legislative Decree 70/2003, the contract is concluded when:
1. The customer selects products and adds them to the cart
2. The customer enters shipping and billing details
3. The customer selects the payment method
4. The customer clicks "Pay now" confirming the order
5. Payment is successfully processed
6. The customer receives the order confirmation email
The contract is concluded when the order form reaches the Seller's server. The confirmation email contains information about the purchase characteristics, price, payment method and shipping costs.
The Seller will ship only after receiving payment authorization. The contract is subject to a resolutive condition of non-payment of the amount due.
6Order Reservations
The Seller reserves the right to refuse or cancel orders that:
• Appear anomalous in relation to quantity and/or frequency of purchases
• Come from a user with whom there is ongoing legal dispute
• Come from a user who has previously violated these Conditions
• Come from a user who has provided false, incomplete or inaccurate identification data
The user guarantees that the personal information provided is complete and truthful and undertakes to hold the Seller harmless from any damage arising from violation of this obligation.
7Order Cancellation
You may request order cancellation by contacting Customer Service at info@bikenos.com.
Cancellation requests will only be accepted if the order has not yet been packed and prepared for shipping.
For orders of €80.00 or more, cancellation will result in a cancellation fee of 3.5% of the total order value, with a minimum charge of €10.00. This amount will be automatically deducted from any refund.
8Product Availability
Products offered on the Site are limited in quantity. It may happen that the ordered product is no longer available after order submission.
In case of unavailability of the ordered product, the customer will be promptly informed and entitled to terminate the contract pursuant to Article 61, paragraphs IV and V, of the Consumer Code.
Alternatively, where restocking is possible, they may accept an extension of delivery terms with indication of the new deadline.
In case of contract termination, refund of the amount paid will be made within 3 working days.
9Prices and VAT
All prices displayed on the site are:
• Expressed in Euros (€)
• Inclusive of VAT applicable to the destination country (e.g., Italy 22%, Germany 19%)
• Valid at the time of order
For sales to non-private entities, the percentage may vary due to possible application of reverse charge. If the destination country has non-applicable VAT, the price is understood as exclusive of VAT.
The Seller reserves the right to modify prices at any time without notice. The price charged will be that indicated on the Site at the time of order.
Shipping costs are indicated separately before order confirmation.
In case of promotions, the previous lowest price of the last 30 days is indicated (Omnibus Directive 2019/2161).
10Discount Codes and Promotional Vouchers
The use of discount vouchers is governed by the following principles:
• If the discount code value is less than the order amount, the difference may be completed with available payment methods
• Discount codes do not entitle to change for purchases of lower amounts
• Any products excluded from discount code use will be duly indicated on the Site
• Discount vouchers cannot be converted to cash
• Unless otherwise indicated, discount codes cannot be combined
11Payment Methods
We accept the following payment methods:
• Credit/debit cards (Visa, Mastercard)
• PayPal
• Apple Pay
• Google Pay
• Klarna (installment payments)
Payments are processed securely via Stripe. Payment card data is encrypted and transmitted directly to the payment processor without passing through our servers. We never have access to and do not store card data.
In application of the PSD2 Directive (2015/2366/EU) on payment services, you may be required to complete the purchase process by satisfying Strong Customer Authentication (SCA) criteria required by the payment institution. Failure to complete the authentication procedure may result in inability to finalize the purchase.
The charge will be made upon order submission, after data verification and authorization from the issuing institution.
12Shipping and Delivery
We ship throughout the European Union. Shipping costs and delivery times are indicated on the dedicated page and in the order summary before confirmation.
The delivery obligation is fulfilled by transferring material possession of the product. Ownership of the products is transferred at the time of shipment (delivery to carrier). The risk of loss or damage is transferred when the customer materially takes possession of the products.
Shipping is insured. In case of damage during transport, contact us within 14 days of receipt.
Delivery times are indicative and do not constitute an essential term. It is recommended to check the packaging integrity upon delivery and report any anomalies on the transport document.
13Delivery Attempts and Storage
The courier will make at least one delivery attempt. If the attempt fails due to causes attributable to the recipient (absence, incorrect address), the shipment may be placed in storage.
The recipient will be informed of collection methods and relevant deadlines. If the package is not collected within the deadlines specified by the courier, or delivery remains impossible due to causes attributable to the recipient, the shipment will be returned to the Seller.
In such cases, the Seller reserves the right to deduct from any refund all shipping costs incurred (outbound and return), with a minimum charge of €15.
14Right of Withdrawal
You have the right to withdraw from the contract within 30 days of receiving the products, without giving any reason.
To exercise withdrawal:
1. Send a formal request via email to info@bikenos.com within 30 days of receipt
2. Return products within 14 days of withdrawal notification
3. Products must be intact, unused and in original packaging with all accessories
Return method:
• Return shipping is at the customer's expense and responsibility
• We do not provide prepaid return labels
• Include the completed return form in the package (downloadable from the link at the bottom of this page)

Refund:
• Within 14 working days of return receipt (average 5 days)
• Using the same payment method used for purchase
• Refund covers product value only, excluding original shipping costs
Exclusions from right of withdrawal:
• Customized or made-to-measure products
• Sealed products for hygiene reasons if opened (e.g., underwear)
• Personal Protective Equipment (PPE): for safety and health protection reasons, all PPE is excluded from withdrawal. This category includes climbing, mountaineering and work-at-height products (e.g., ropes, harnesses, carabiners, helmets, slings, lanyards, fall arrest devices). Such items, once sold, cannot be returned.
Refund deductions:
If the product shows signs of use, damage or tampering, the Seller reserves the right to apply a proportional deduction from the refundable amount or to reject the return.
Use of the product beyond what is necessary to verify its nature and characteristics results in a reduction of the refundable value.
Bikenos FZ disclaims any responsibility for lost or misdirected return shipments.
15Legal Warranty
All products are covered by the 2-year legal warranty of conformity from delivery (Directive 2019/771).
The warranty covers:
• Defects present at the time of delivery
• Defects appearing within 2 years of delivery
Presumption of defect:
• For defects appearing within 1 year of delivery, it is presumed they existed at delivery
Available remedies (at your choice, unless disproportionate):
• Product repair
• Product replacement
• Price reduction
• Contract termination (if defect is serious)
Not covered:
• Damage from improper use
• Normal wear from intensive use
• Damage caused by accidents or negligence
16Manufacturer's Conventional Warranty
Products sold may be covered by a conventional warranty issued by the manufacturer. Such warranty may only be enforced against the manufacturer.
The duration, territorial scope, conditions and methods of use, types of damage/defects covered and any limitations of the conventional warranty depend on the individual manufacturer and are indicated in the documentation accompanying the product.
The conventional warranty is voluntary and does not replace, limit, prejudice or exclude the Legal Warranty of conformity.
17Limitation of Liability
Bikenos is not responsible for:
• Delivery delays due to force majeure
• Damage from improper product use
• Temporary website unavailability
• Typing errors in customer-provided information
Our liability is limited to the order value.
18Applicable Law and Jurisdiction
The contract is governed by Italian law. Application of any more favorable and mandatory provisions of the law of their country is reserved for consumer users who do not have their habitual residence in Italy.
For any dispute arising from the contract, the Court of Pesaro (Italy) shall have exclusive jurisdiction.

19Alternative Dispute Resolution (ADR/ODR)
Pursuant to Article 141-sexies, paragraph 3 of the Consumer Code, we inform you that in case of dispute, the consumer may resort to alternative dispute resolution (ADR) procedures provided for in Title II-bis of the Consumer Code.
A European platform for online consumer dispute resolution (ODR platform) has been established, accessible at:

Through the ODR platform, consumers can consult the list of ADR bodies, find links to each of their websites and initiate online dispute resolution procedures.
In any case, the consumer's right to bring action before the competent ordinary court is reserved.
20Customer Service and Complaints

The Seller will respond to complaints within 3 working days of receipt.
21Invoice Issuance
If the customer wishes to receive an invoice with Tax Code or VAT number, they must expressly request it during the order process by completing the appropriate fields.
Any invoice requests made after order completion cannot be accepted for tax and administrative reasons.
22Post-Sale Communications
The customer authorizes the use of their email for:
a) Review requests: to receive a review request about the purchase experience following order delivery.
b) Promotional communications: to receive commercial communications about products and services similar to those purchased, pursuant to Article 130, paragraph 4 of Italian Legislative Decree 196/2003 (soft-spam). This processing is based on the Seller's legitimate interest.
The customer may object at any time to receiving promotional communications by:
• Using the unsubscribe link in each email
• Sending a request to info@bikenos.com
• Accessing their personal area on the site
Objection to promotional communications does not affect the receipt of technical communications necessary for order management.
